Welcome to EV.Pro, the EV-as-a-Service of CurrentFleet, LLC. ("EV.Pro", "Company", "we", "us", or "our"). This Privacy Notice outlines how we handle personal information, both collected automatically and provided by individuals, in connection with our websites, which include https://ev.pro and other websites owned and operated by us that link to this Privacy Notice (referred to as the "Sites"), and the associated content, platform, services, products, and other features offered through our online services (collectively, the "Services"). This Privacy Notice does not pertain to our privacy practices concerning EV.Pro employees and other personnel.

 

Our Data Collection Practices

In this Privacy Notice, the term "personal information" refers to information that pertains to an individual or that could reasonably be linked directly or indirectly to an individual. It excludes publicly available, aggregated, or anonymized information.

We collect personal information in various ways. Sometimes, personal information is collected automatically when an individual interacts with our Services, while at other times, we collect it directly from the individual. Additionally, we may obtain personal information about individuals from third-party sources before our initial direct interaction with them.

It is important to note that in certain situations, the provision of personal information is optional. Choosing not to share specific information with us may affect our ability to serve you effectively or offer our Services. Any information that you provide beyond what is necessary for using our Services is voluntary.

By using our Services or engaging with us in any manner, you agree to the practices outlined in this Privacy Notice, which include the collection, use, and disclosure of personal information as detailed herein. If you do not agree with this Privacy Notice, please refrain from accessing our Sites or Services.

 

Personal Information You Provide

We may collect the following personal information that individuals submit to us through the Services:

  • Contact Data: This includes first and last names, phone numbers, email addresses, physical addresses, and communication preferences.
  • Payment Data: This category encompasses payment status, billing addresses, billing phone numbers, credit/debit card information (including name, number, expiration date, and security code), bank details (such as name, address, account name, account number, and routing number), and third-party payment identifiers and confirmations. Please note that we engage third-party payment processors, such as Stripe, to handle ACH, debit, and credit card payments. We do not retain credit card numbers, as these are directly provided to our third-party processor. Stripe's handling of personal information is governed by its Privacy Policy. For certain purposes, EV.Pro may employ Plaid, Inc. ("Plaid") to connect bank accounts with Stripe, validate bank accounts, view account balances and transaction histories to assess eligibility for our Services, and confirm bank account balances before approving ACH transactions. Plaid transmits bank account and routing numbers directly to Stripe, and EV.Pro does not collect this information for Plaid accounts. Information shared with Plaid is treated in accordance with its Privacy Policy.
  • Identity Data: This includes Social Security numbers, dates of birth, driver's license numbers, automobile insurance details, employment information, and other consumer and identity-related data necessary for conducting background checks, verifying income, confirming identity, preventing and detecting fraud, theft, or abuse, and determining eligibility for our Services. It is worth noting that some of this information is collected directly by third-party providers, rather than by EV.Pro.
  • Third Party Platform Data: With individuals' consent, we may collect credentials, data related to driving records, performance ratings, customer reviews, earnings, and hours worked on third-party platforms like Doordash or Uber.
  • Communications: When you contact us, whether by responding to our messages, subscribing to our email newsletter, or reporting incidents involving our Services, we collect any information you provide (including attachments). We also gather information that is evident from your communication, such as the email address or phone number used to contact us. If you communicate with us via phone, we may record the audio of our conversations, in compliance with applicable laws. In some cases, we may offer you the opportunity to specify your communication preferences for future interactions (e.g., choosing between physical mail, email, or text messages), and we will collect any preferences you express.
  • Feedback: We gather feedback and ratings provided by users concerning their experiences or any other matters related to the Services.
  • Survey Information: This category encompasses responses to survey questions or the content of testimonials.
  • Other Data: We may also collect personal information at other instances on our Services to provide the features or functionalities of the Services and for other purposes described in this Privacy Notice. We may additionally receive personal information or data when individuals submit it to us in different contexts.

Kindly note that in addition to your direct provision of the mentioned information, we may also acquire this data through intermediaries and external parties acting on our behalf. These intermediaries and third-party entities encompass, without being confined to, communication facilitators, verification agencies for background checks, providers verifying employment and income, agencies offering marketing services, analytical researchers, and the managers of our vehicle fleet.

 

Personal Data Collection From Service Usage

  • Vehicle Data: All our vehicles are equipped with connected car technology, allowing them to gather information related to the vehicle and its use. This data includes the vehicle's condition, records of damage and accidents, performance metrics, operational data, diagnostics, mileage information, acceleration, braking, speed, g-force, trip details (such as duration and routes), battery status, tire pressure, odometer readings, location, direction, proximity to other vehicles, and other vehicle-related information (referred to as "Connected Vehicle Data"). It's important to note that while Connected Vehicle Data is primarily associated with the vehicle, if it can be linked to you and used for identification purposes, we treat it as personal information.

The utilization of features and built-in services in connected cars may be subject to your master agreement with the vehicle provider, terms and conditions set by the vehicle manufacturer, or the technology provider. These terms may encompass system and service limitations, warranty exclusions, liability restrictions, wireless service provider terms, and user responsibilities. Certain features may remain active even when other services or media in the vehicle are turned off. Depending on your vehicle's technology, vehicle manufacturers and built-in services like "Apple CarPlay" or "OnStar" may also collect Connected Vehicle Data or other personal information from the vehicle in accordance with their respective privacy policies. 

  • Devices Data: We may gather information regarding the devices and web browsers you use to access our Services. This may encompass your internet protocol (IP) address, operating system, browser type, browser language, screen resolution, the URL you entered, the relevant referring page or campaign, and details about the mobile devices you use to access our Services (including hardware model, version, device identifiers, operating system, battery level, charging status, and screen size).
  • Engagement Data: We collect data pertaining to how you engage with our Services, including automatically logged data. Usage Information may encompass, but is not limited to, details about specific components of the Site or any other aspect of the Services you visit or use. This includes information about pages or screens viewed, the duration spent on a page or screen, navigation paths between pages or screens, activity on a page or screen, access times, and the length of access. Additionally, it includes alerts or communications sent to you in connection with your use of the Services and any errors that may have occurred during your usage.
  • Location Data: We collect location-related data in various ways, depending on your usage of the Services. For instance, with your consent, we may gather precise geolocation data and other driving-related information, such as real-time latitude and longitude during your trips. This may also encompass general location data, such as the direction of travel, trip details, distance traveled, and timestamps for data collection. In cases where precise geolocation data is not provided, we may still collect general location data based on automatically collected Device Information and Usage Information, as defined above.
  • Analytics & Cookie Data: Similar to most online service providers and platforms, we collect information concerning the electronic pathway you take to access, navigate, and exit our Services, as well as your interactions and activities on our platform. This encompasses the links, objects, products, and features you view, click on, or otherwise engage with. Both we and our third-party service providers and business partners may collect and store data through methods like "cookies," related technologies (such as pixels and web beacons), and third-party analytics services (e.g., Google Analytics and Hubspot). We gather this information for purposes including the retention of user preferences and settings, analysis of the effectiveness of specific features, and the planning and execution of marketing campaigns.  

 

Personal Information Received from External Sources

At times, we may obtain personal information about you from the following external sources and combine it with other data we have:

  • Social Media: When individuals engage with our Services through various social media platforms, such as "Liking" our content on Facebook, sharing our content on Google, following us on Twitter, or similar interactions on other social networks, we may receive certain information that individuals permit these platforms to share with third parties. The information we receive depends on an individual's privacy settings on the respective social network. It may include profile information, profile pictures, gender, usernames, user IDs associated with social media accounts, age ranges, language preferences, country details, and any other data individuals allow the social network to share with third parties. It is advisable for individuals to regularly review and, if necessary, adjust their privacy settings on third-party websites and social media platforms before sharing information or linking/connecting them to other services. We use this information to operate, maintain, and provide the features and functionality of our Services. Additionally, it enables us to communicate directly with you, such as sending email messages about products and services that might pique your interest.
  • Vendors, Partners & Provideres: We collaborate with a diverse range of third-party service providers and business partners who contribute to the availability and enhancement of our Services. These partners encompass providers of data storage and processing services, mapping services, customer support, background check services, employment and income verification services, fraud prevention and security services, troubleshooting services, communications services, insurance providers, research and analytics providers, professional service providers (including our fleet managers), telematics service providers, payment processors, and marketing and social media service providers. In specific scenarios, we may also partner with businesses like car-sharing and ride-sharing gig platform providers or advertising providers, which offer products or services to drivers interested in participation. These service providers and business partners may collect your personal information when you provide it to them or automatically when you interact with their services, and they may share that information with us.
  • Referrals: We may employ referral promotions to encourage our users and partner businesses to spread the word about our Services to their friends, family, customers, and other contacts (referred to as "Referred Persons").
  • External Sources: We may gather personal information from publicly available sources, including government records or public websites, or from other third parties, such as data and mailing list providers, regulatory authorities, law enforcement agencies, media organizations, or insurers. This is done to rectify or supplement the personal information we have collected about you from other sources.



Use of Personal Data

We leverage the personal information we collect for various purposes, including:

  • Business Management: Managing the day-to-day operations of our business.
  • Communication: Engaging with individuals through email and social media.
  • Marketing and Advertising: Utilizing personal information for marketing and advertising purposes, which includes promoting our services via email, direct mail, and providing updates on products or services that may be of interest to you.
  • Service Enhancement: Testing, improving, updating, and monitoring our Services, as well as diagnosing and resolving technology-related issues.
  • Customer Support: Facilitating customer benefits and services, including customer support.
  • Research and Analytics: Conducting research and analytics on our customer and user base and our Services.
  • Customization: Enhancing and customizing our Services to cater to the needs and interests of our user base and other individuals we interact with.
  • Safety and Security: Monitoring and providing predictive maintenance and usage-based insurance, fleet management, vehicle recovery, enabling third-party vehicle applications and services, enhancing road safety, reducing traffic, preventing fraud or fraudulent activities, identifying or investigating unsafe behaviors, and performing background checks on drivers before authorizing them to use our Services.
  • Eligibility Determination: Verifying eligibility to use our Services.
  • Contractual Obligations: Fulfilling contractual obligations and delivering the Services.
  • Legal and Contractual Compliance: Fulfilling or enforcing legal or contractual obligations and requirements (including those in our Terms of Service), resolving disputes, protecting our business interests and the interests and rights of third parties, and preventing, investigating, or notifying about fraud or unlawful activities.
  • Other Lawful or Consensual Purposes: For any other lawful purpose, or for any purpose for which you provide your information or consent.

In cases where you contact us, additional information may be required to fulfill your request or respond to inquiries. For inquiries or requests that fall outside the scope of this Privacy Notice, we may provide you with additional privacy-related information, which will govern how we process the information provided at that time.

Aggregate Data: We may aggregate and/or anonymize information gathered through the EV.Pro Services to the point where it can no longer be linked to you or your device (referred to as "Aggregated/Anonymized Information"). This Aggregated/Anonymized Information may be used for various purposes, including research and analytics, and may be shared with third parties, including partners, affiliates, service providers, and others.

 

How We Share Your Personal Information:

Our commitment to transparency includes explaining how we share your personal information, as detailed below. For more information on your choices regarding your information, please refer to the "Control Over Your Information" section further down.

We share personal information in various ways:

  • Affiliates: We may share personal information with other companies under the ownership or control of EV.Pro. This includes our subsidiaries (organizations we own or control), our ultimate holding company (organizations that own or control us), and any subsidiaries owned by our ultimate holding company. This sharing often occurs when we collaborate to provide our Services.
  • Contests, Sweepstakes, and Surveys: We collaborate with third parties who assist us in conducting contests, sweepstakes, or surveys, as well as processing the responses received.
  • Marketing Providers: Personal information may be shared with our marketing providers to facilitate communications with individuals regarding the Services we offer.
  • Communication Providers: We engage third parties to assist in delivering customer services and facilitating communication with individuals who submit inquiries.
  • Service Providers: We may share some or all of your personal information with service providers who perform various services on our behalf. These service providers belong to categories such as:
  • Background Checks: In some situations, and in accordance with applicable laws and regulations, we may engage third parties offering background checks and identity verification services.
  • Employment Verification: Similarly, in compliance with applicable laws and regulations, we may work with third parties that provide income and employment data directly from gig platforms.
  • Data Storage: Our Services are hosted on cloud servers, and we collaborate with third-party vendors for tasks such as data collection, processing, storage, retrieval, and aggregation.
  • Customer Success: We work alongside third parties to provide support services, including call centers, email support, and chat support.
  • Communications: We engage vendors to provide communication services for tasks such as managing and sending emails, text messages, or telephone calls.
  • Mapping & Location: Third-party software assists in mapping functions used within our Services.
  • Professional Services: We may consult or retain lawyers, accountants, government affairs or subject matter experts, and other professionals.
  • Fraud Prevention: Vendors help us detect and prevent fraudulent use of our Services, maintain the data security of our systems, identify and resolve errors or incidents that may impact the Services. In some cases, we collaborate with video recording and telematics service providers to promote safe usage of our Services and assist in incident response.
  • Analytics: Service providers assist in aggregating personal information and providing insights into how our Services are utilized.
  • Insurance: We partner with insurance companies, adjusters, brokers, and claims administrators to facilitate insurance services and claims processing related to insurance policies.
  • Advertising Networks: We collaborate with third-party ad networks and advertising partners to deliver targeted advertisements and personalized content through our Services, as well as on other websites, services, and across various devices. These parties may collect information directly from your browser or device when you access our Services, typically through tracking technologies like cookies, web beacons, embedded scripts, location-identifying technologies, and similar methods. This information includes clickstream data, browser type, the time and date of your visit to our Sites, AdID, precise geolocation, and more. To enhance the relevance of online advertisements to your interests and to provide advertising-related services like reporting, attribution, analytics, and market research, we may also share a common account identifier (such as a hashed email address or user ID) with our third-party advertising partners.
  • Business Transactions or Reorganization: In scenarios involving corporate business transactions, such as mergers, acquisitions, joint ventures, financing, or the sale of company assets, we may disclose personal information to third parties. Personal information may also be disclosed in the event of insolvency, bankruptcy, or receivership.

  • With Your Consent: Personal information about an individual may be disclosed to specific third parties or made public with their consent or direction.

 

Third-Party Data Collection and Online Advertising:

We participate in interest-based advertising and collaborate with third-party advertising companies to deliver targeted advertisements based on your browsing history. We allow third-party online advertising networks, social media companies, and other third-party services to collect information regarding your use of our online services over time. They may display ads on our Services, on other websites or services you use, and across different devices.

Typically, though not exclusively, the information used for interest-based advertising is collected through tracking technologies such as cookies, web beacons, embedded scripts, location-identifying technologies, and similar technologies. These technologies identify the device you are using and collect information, including clickstream data, browser type, visit timestamp, AdID, precise geolocation, and more.

We may share a common account identifier, like a hashed email address or user ID, with our third-party advertising partners to help identify you across devices. We and our third-party partners use this information to make the advertisements you see online more relevant to your interests. Additionally, this information

 

Control Over Your Information:

You have the ability to manage your information through various means:

  • Emails and Notifications: If you wish to stop receiving promotional email communications from us, simply click on the “unsubscribe” link provided in such emails. Please note that service-related communications, such as account verification, transactional updates, changes/updates to features of the Services, technical and security notices, cannot be opted out of. Similarly, you can unsubscribe from receiving SMS text messages by replying “STOP” to the sender's number. We ensure prompt processing of all unsubscribe requests.
  • Modifying Data: For questions about reviewing, modifying, or deleting your information, please reach out to us directly at team@ev.pro.
  • Online Ads: To understand more about interest-based advertising and explore opt-out options, you can visit the Digital Advertising Alliance (DAA) at www.aboutads.info/choices or the Network Advertising Initiative (NAI) at http://www.networkadvertising.org/choices/. On your mobile device, you may also have the option to limit interest-based advertising through your settings menu. On iOS, you can select “limit ad tracking,” while on Android, you can choose “opt-out of interest-based ads.” Additionally, you might be able to opt-out of some (but not all) interest-based advertising served by mobile ad networks by visiting http://youradchoices.com/appchoices and downloading the mobile AppChoices app.

Please note that opting out of interest-based advertisements doesn't mean you won't see ads from us or on our online services. It means that the online ads from DAA program participants shouldn't be based on your interests. We cannot vouch for the effectiveness or compliance of any third-party opt-out options or programs, nor can we guarantee the accuracy of their statements regarding their programs. Additionally, third parties may still employ cookies to gather information about your use of our online services, including for analytics, fraud prevention, and other purposes permitted under the DAA’s Principles.

  • Cookies: To manage cookies, you can adjust your browser settings to:
    • Notify you when you receive a cookie, allowing you to decide whether to accept it.
    • Disable existing cookies.
    • Automatically reject cookies.

Be aware that altering these settings may impact your experience using our Services, as certain features and offerings may not work correctly or at all. Additionally, depending on your device and operating system, you might not have the capability to delete or block all cookies. Furthermore, to reject cookies across multiple browsers and devices, you must configure these settings individually for each browser on each active device. You can also adjust your email settings to prevent the automatic downloading of images, which might contain technologies enabling us to track whether you've accessed our email and performed certain actions with it.

Children’s Data:

Our Services are not designed for or directed towards children under the age of 13. We do not knowingly collect or solicit personal information from individuals under 13 years old. If a child under 13 has provided personal information to us, we encourage their parent or guardian to contact us and request the removal of that information from our systems. Should we learn that we have collected personal information from a child under 13, we will promptly delete it.

We are not responsible for the personal information practices of third-party websites, online services, or other third parties. Region-Specific:

  • California – Your California Privacy Rights: California residents have the right, under California Civil Code Section 1798.83, commonly known as the "Shine the Light" law, to request information regarding the disclosure of their personal information to third parties for direct marketing purposes during the preceding calendar year. To opt out of such disclosures, please contact us at team@ev.pro with the subject line “California Shine the Light Request”.
  • Nevada: If you are a resident of Nevada, Chapter 603A of the Nevada Revised Statutes allows you to opt out of future sales of certain covered information collected or to be collected by a website operator. Although we don't currently sell covered information, please reach out to us at team@ev.pro with the subject line “Nevada Opt Out Request” to make such a request.

We periodically update this Privacy Notice. When changes are made, we will post the updated version on this page (https://ev.pro/privacypolicy) and update the date at the beginning of the Privacy Notice. For significant changes, we will notify individuals by email to their registered email address, through prominent postings on our Services, or using other suitable communication channels. All changes become effective on the date of publication, unless stated otherwise. By continuing to use our Services or providing us with personal information after we've posted an updated Privacy Notice or notified you of changes, you consent to the revised Privacy Notice and its described practices.
