EV.PRO Privacy Policy

1. Introduction

This Privacy Policy explains how EV.PRO, Inc. and its subsidiaries ("EV.PRO," "we," "us" and "our") collect, use, share and protect personal information. It applies to https://ev.pro and any other website we operate that links to this policy (the "Sites"), and to the EV-as-a-Service offerings we provide to business customers, including vehicles, charging, operations and maintenance, and any customer portal (together with the Sites, the "Services").

EV.PRO serves businesses and other organizations. Most personal information we handle relates to people acting for those organizations, such as fleet managers, procurement contacts and drivers of fleet vehicles. This policy does not cover information about our own employees and job applicants.

Information we handle for fleet customers. When we provide Services to a fleet customer, we may process information about that customer's drivers and vehicles, such as telematics and charging data, on the customer's behalf and under our agreement with them. If you drive a vehicle provided through one of our customers, that customer's own privacy practices also apply, and you may wish to contact them with questions about your data.

This policy should be read together with our Terms of Use.

2. Information We Collect

"Personal information" means information that identifies, relates to or could reasonably be linked to an individual. It does not include information that is publicly available, de-identified or aggregated.

Information you provide

  • Contact and business information: name, company, job title, email address, phone number, business address and communication preferences, for example when you request a quote, fill in a contact form or sign an agreement
  • Fleet and service information: details about your fleet, vehicles, sites, routes, duty cycles and charging needs
  • Account information: login credentials and profile details if you use a customer portal
  • Billing and payment information: billing contacts and addresses, payment history and bank or card details. Card and bank payments are handled by third-party payment processors such as Stripe, and we do not store full card numbers
  • Credit and verification information: business information such as legal name, tax identification number, financial statements and credit history, used to assess eligibility for leases, subscriptions and financing. If an individual provides a personal guarantee, we or our financing partners may collect that person's identity and credit information with their authorization
  • Driver information: for drivers authorized to operate vehicles we provide, information such as name, contact details and driver's license details, where our customer agreement or insurance requirements call for it
  • Communications: the content of emails, calls, texts and other messages you send us, including attachments. We may record calls where permitted by law
  • Feedback: survey responses, reviews, testimonials and other feedback

Information collected automatically from the Sites

  • Device and usage information: browser type, operating system, device type, referring page, pages viewed and time on page. Our analytics are described in Section 5
  • Approximate location: general location inferred from your IP address

Vehicle and charging data

Vehicles and chargers we provide or maintain may be equipped with telematics and connected technology. This can collect information such as vehicle location and trips, mileage, speed, braking and other driving events, battery state of charge and health, charging sessions and energy use, diagnostic codes, tire pressure, and maintenance and damage records ("Vehicle Data"). Vehicle Data primarily describes the vehicle, but we treat it as personal information when it can be linked to an identifiable driver.

Vehicle manufacturers, telematics providers and charging networks may also collect Vehicle Data under their own terms and privacy policies.

Information from other sources

  • Your organization: fleet customers may provide information about their authorized users and drivers
  • Business partners: vehicle manufacturers, dealers, financing partners, insurers, charging and energy providers, and referral partners
  • Service providers: telematics providers, credit reporting and verification agencies, and fraud-prevention services
  • Public sources: business registries, government records, professional networking sites and other publicly available information

3. How We Use Information

We use personal information to:

  • Provide the Services: prepare quotes, enter into and perform agreements, deliver and maintain vehicles and chargers, manage charging, and run customer portals
  • Monitor fleet performance: track vehicle uptime, battery health, charging and maintenance needs, and report on them to our customers
  • Support safety and security: respond to incidents and roadside events, recover vehicles, and detect and prevent fraud, theft and misuse
  • Assess eligibility: evaluate applications for leases, subscriptions and financing, together with our financing partners
  • Bill and collect: process payments, invoices and collections
  • Communicate with you: respond to inquiries, send service notices, and provide customer support
  • Market our Services: send information about our Services that may interest you, which you can opt out of at any time
  • Improve our business: analyze how the Sites and Services are used, and develop new features and offerings
  • Meet legal obligations: comply with laws, regulations, incentive and grant program requirements and legal process, and enforce our agreements
  • Other purposes: for any other purpose we describe when we collect the information, or with your consent

Automated tools. We use software tools, including artificial intelligence tools, to help analyze vehicle and operational data, draft communications and support our team. We do not use personal information to make decisions that produce legal or similarly significant effects on individuals solely through automated processing.

De-identified data. We may create aggregated or de-identified data that can no longer reasonably be linked to an individual, and use or share it for any lawful purpose, such as benchmarking fleet performance. We will not attempt to re-identify it.

4. How We Share Information

We do not sell personal information, and we do not share it for cross-context behavioral advertising. We share personal information only as described below.

  • Our customers: we share Vehicle Data and related driver information with the fleet customer that operates the vehicle, as part of the Services
  • Service providers: companies that work on our behalf, such as telematics, cloud hosting, software (including AI tools), payment processing, communications, customer support, maintenance and roadside technicians, and professional advisers. They may use personal information only to provide services to us
  • Business partners: vehicle manufacturers, dealers, upfitters, charging and energy providers, and insurers, where needed to deliver, service, insure or warranty vehicles and equipment
  • Financing partners: lenders, lessors and their assignees that finance or hold leases and agreements for vehicles and equipment we provide, including for credit review, servicing and collections
  • Incentive programs: government agencies and program administrators, where needed to apply for or comply with grants, rebates and tax credits on your behalf
  • Affiliates: our parent companies, subsidiaries and companies under common control
  • Business transfers: a buyer, investor, lender or successor in connection with a merger, acquisition, financing, sale of assets, or insolvency
  • Legal and safety reasons: courts, regulators, law enforcement and others, where we believe it is required by law or needed to protect the rights, property or safety of EV.PRO, our customers or others
  • With your consent or at your direction

5. Cookies, Analytics and Advertising

The Sites use Vercel Analytics to measure page views and site performance. It is cookieless: it records aggregate usage and does not set cookies or store information that identifies you personally.

We do not currently use advertising cookies, tracking pixels or third-party advertising networks on the Sites. If we add them in the future, we will update this policy first and offer any choices required by law, including honoring opt-out preference signals such as Global Privacy Control.

Our Sites may use strictly necessary cookies or similar technologies to operate features such as forms, security and customer portal sign-in. You can set your browser to block cookies, but some features may not work.

Our marketing emails may contain standard technology that tells us whether an email was opened. You can prevent this by turning off automatic image loading in your email client.

6. Retention and Security

Retention. We keep personal information for as long as needed for the purposes described in this policy. That includes the life of a customer relationship and any agreement, and after that as long as needed to meet legal, tax, accounting, warranty, insurance, incentive program and financing requirements, resolve disputes and enforce our agreements. When we no longer need it, we delete it or de-identify it.

Security. We use reasonable administrative, technical and physical safeguards to protect personal information, including access controls and encryption in transit. No system is completely secure, and we cannot guarantee the security of information transmitted to us or stored in our systems.

Where we process data. We are based in the United States, and we store and process personal information in the United States.

7. Your Choices and Privacy Rights

Marketing communications. You can unsubscribe from marketing emails using the link in any such email, and stop text messages by replying STOP. We will still send service messages, such as notices about your agreement, billing, vehicles or security.

Your rights. Depending on where you live, you may have the right to:

  • Know what personal information we have about you and how we use and share it
  • Get a copy of your personal information
  • Correct inaccurate personal information
  • Delete your personal information
  • Opt out of the sale of personal information, targeted advertising or certain profiling. As noted above, we do not sell personal information or use it for targeted advertising

To make a request, email team@ev.pro with the subject line "Privacy Request." We will verify your identity before acting on it, which may require you to confirm information we already hold. You may use an authorized agent to make a request on your behalf, and we may ask for proof of their authorization. Some requests may be limited where we need to keep information for legal or contractual reasons, or where the information belongs to a fleet customer we serve.

If we deny your request, you may appeal by replying to our decision with the subject line "Privacy Request Appeal." If you are not satisfied with the outcome of an appeal, you may contact your state attorney general. We will not discriminate against you for exercising your privacy rights.

California. Under California's "Shine the Light" law (Civil Code Section 1798.83), California residents may ask whether we have disclosed personal information to third parties for their own direct marketing purposes in the preceding calendar year. We do not make such disclosures. To ask, email team@ev.pro with the subject line "California Shine the Light Request."

Nevada. Nevada residents may submit a request to opt out of the sale of covered information under Chapter 603A of the Nevada Revised Statutes. We do not sell covered information, but you may submit a request by emailing team@ev.pro with the subject line "Nevada Opt-Out Request."

8. Children

The Services are intended for businesses and are not directed to children under 16. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, contact us and we will delete it.

9. Third-Party Websites and Services

The Sites may link to websites and services operated by others, such as vehicle manufacturers, charging networks and social media platforms. This policy does not apply to them, and we are not responsible for their privacy practices. Please review their privacy policies.

10. Changes to this Policy

We may update this policy from time to time. We will post the updated version on this page and change the "Last updated" date above. If we make material changes, we will provide additional notice, such as by email or a notice on the Sites.
